Vibz — Terms of Service

Version: 1.0.0 Effective date: 2026-09-17 Last updated: 2026-09-17 Operator: Midwest Technical Training & Consulting INC, a Missouri corporation ("Vibz", "we", "us").

These Terms of Service (the "Terms") govern your use of the Vibz mobile applications, website, and related services (collectively the "Service"). By creating a Vibz account or otherwise using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Vibz, or such greater minimum age required in your country or territory. We determine your country from your phone number at signup and apply the strictest applicable minimum age; if your date of birth is below that minimum, we do not create the account. If you are under 18 (or the age of majority where you live), you confirm that a parent or legal guardian has reviewed these Terms with you and consents to your use of the Service, and certain features of the Service will be disabled or restricted for your account (see our Age & Teen Safety Policy).

If we learn that an account belongs to someone under the minimum age, we will ban the account and delete the associated personal information. We may, at our sole discretion, refuse, suspend, or terminate accounts.

2. Your account

Companion Accounts for Minors

Where teen social access controls are enabled, an eligible minor may link to one adult account after both accounts approve. The adult account must have a declared date of birth indicating age 18 or older and the adult must attest that they are authorized to supervise the minor; this flow is not government-ID or relationship verification. The adult may allow or withhold specific social capabilities for the minor. The link does not let the adult act as the minor, read or decrypt messages, listen to calls, receive communication copies, or monitor activity. Either linked account may revoke the link. Age-restricted content, adult-oriented recommendations, private groups, view-once media, disappearing media, and other age-restricted features remain blocked.

End-to-end encryption, backups, and loss of private content

What is end-to-end encrypted. Posts you share with a private, subscriber-only, or mutual audience, all vibes, and the captions on that content are end-to-end encrypted. They are encrypted on your device before they are uploaded, and only the accounts you share them with can decrypt them. Vibz stores this content only in encrypted form and cannot read it. Content you publish publicly is not end-to-end encrypted, and neither is the information Vibz needs to run the Service, such as account and post identifiers, timestamps, the audience you chose, and delivery and access records. Direct messages and groups are described in section 5.

Your keys stay on your device. The keys that unlock your end-to-end encrypted content are created and stored on your device, and are included in your backups. Vibz does not hold a copy of these keys and cannot reset or replace them for you.

Backups. We encrypt your backups to protect them if your device is stolen, and we store the key to your encrypted backup securely on our servers. We store only that key. The backup file itself stays on your device or in your own Google Drive or iCloud account, and is encrypted before it leaves your device. To get the key back, you verify that you own your phone number by SMS. Vibz does not receive your backup files. Backups stored in your cloud account are also subject to your provider's terms and privacy policy.

Recovery key (optional). You can create a recovery key in Chat Backup settings as an extra layer of protection. It is a code generated on your device that you write down or save yourself, and it can also open your backups. Vibz never sees it, and the app cannot show it to you again after it is created. If you lose it, you can create a new one from Chat Backup settings, and the old key stops working for backups made after that.

Changing phones. When you change phones, you can transfer from your other phone with the in-app phone-to-phone transfer, or restore from a backup. The transfer moves the keys for your end-to-end encrypted content; it does not move chat history. Chat history is restored only from a backup made on the same platform (iOS or Android), so a transfer between an iPhone and an Android phone does not include chat history.

Your choice, and the risk of losing content. It is your choice whether to keep your phone's backup, turn on cloud backup, or transfer your keys to a new phone, and we recommend turning on cloud backup. If you lose your phone and have no backup you can restore and no other phone to transfer from, you permanently lose access to the end-to-end encrypted content those keys protect, and to any chat history that is not in a backup. Vibz cannot restore it.

To the extent permitted by law, Vibz is not responsible for the loss of end-to-end encrypted content, keys, or chat history that results from the loss, theft, reset, or failure of your device, from the loss of access to your Google or Apple account or your recovery key, or from a backup that you did not make or that cannot be opened. This paragraph does not limit any right you have under applicable law that cannot be waived.

Reports. A content key that you explicitly supplied with a subscriber-post report may let authorized moderation review that reported target, but it is not an account-recovery key.

If your account can't be recovered. If you sign in on a phone that has no way to recover your account (no transfer from another phone and no backup), signing in starts a new account on your phone number. We can't confirm that the person signing in is the account's previous owner, because phone numbers get reassigned, so the new account starts empty and nothing from the previous account moves to it. The previous account is closed: it is signed out everywhere and hidden from other people. It can be recovered for 30 days with its backup, its recovery key, or a transfer from a phone that still holds its keys. After 30 days it is deleted as described in section 9, subject to the legal and safety retention the Privacy Policy describes. Content that can't be decrypted can't be restored.

Inactive accounts. If your account has been inactive for 45 days or more, signing in on its phone number from a phone with no recovery path is treated the same way: the previous account is closed and a new one starts, as described above.

3. Acceptable use — what you may not do

We have a zero-tolerance approach to behavior that endangers our users. You may not, and may not attempt to:

1. Post, transmit, or otherwise share child sexual abuse material (CSAM) or any content that sexualizes minors. Confirmed violations may result in permanent account action and, where reportable, submission to the National Center for Missing & Exploited Children (NCMEC) or disclosure to law enforcement as required by law.

2. Post content that is pornographic, depicts explicit sexual activity, uses nudity for sexual gratification, solicits prostitution or escort services, or offers or requests sexual services or adult content.

3. Threaten, harass, stalk, dox, or incite violence against any person or group.

4. Promote terrorism, violent extremism, or organized criminal activity.

5. Promote suicide, self-harm, or eating disorders.

6. Engage in hate speech based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or serious disease.

7. Sexually exploit, traffic, coerce, or solicit any person, including through DMs, calls, channels, or off-platform payment links.

8. Sell, promote, or facilitate the sale of regulated goods (drugs, weapons, counterfeit goods, stolen goods).

9. Impersonate another person, brand, or Vibz itself; misrepresent your affiliation with anyone.

10. Distribute spam, scams, phishing links, malware, or unsolicited commercial messages; create fake accounts, buy/sell engagement, or use automated tools without our written permission.

11. Infringe anyone's intellectual property, privacy, publicity, or other rights.

12. Reverse-engineer, decompile, scrape, or otherwise interfere with the Service or its security; bypass rate limits, attempt unauthorized access, or use the Service to attack any system.

13. Use the Service in violation of any applicable law.

You also agree to follow our Community Guidelines, which expand on the rules above with examples.

4. Your content

You keep ownership of the content you create on Vibz ("Your Content"). By posting Your Content to the Service you grant Vibz a worldwide (so we can show your content wherever the Service is available), royalty-free (you don't owe us and we don't owe you any payment), non-exclusive (you can use Your Content anywhere else), transferable, sub-licensable license to host, store, reproduce, modify, create derivative works of, communicate, publish, publicly perform and display, and distribute Your Content for the limited purpose of operating, providing, improving, and promoting the Service. This license ends when Your Content is deleted from our systems, except as needed to comply with law, enforce these Terms, or for backup purposes for a limited retention period.

Vibz grants you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use the Service, subject to and in accordance with these Terms.

You represent that you have all rights necessary to grant the license above and that Your Content does not violate any law or these Terms.

We may remove, restrict, or refuse to publish any content that violates these Terms or our Community Guidelines, or that we believe in good faith may expose Vibz or its users to risk. We are not obligated to host any content.

When a subscriber unsubscribes, is blocked, or is removed, access to all posts from that channel ends. Vibz stops returning the feed rows, encrypted grants, and signed media URLs and the app purges its cached copies. This cannot revoke ciphertext or keys that a modified client already downloaded, and the guarantee depends on CDN expiry enforcement. Vibz does not promise that a prior download can be recalled.

Copyright, takedowns, and repeat infringers

If you believe content on Vibz infringes your copyright, send a notice to our designated copyright agent. The agent's details, the information a notice must contain, and the counter-notification process are published at marketvibz.com/legal/dmca. We respond to valid notices under the U.S. Digital Millennium Copyright Act and remove or disable access to material we remove in response.

We have adopted and reasonably implement a repeat infringer policy. Content removed following a valid copyright notice results in a strike against the account that posted it. Strikes lead to escalating restrictions on the account and, in appropriate circumstances, permanent termination. Strikes expire 90 days after they are issued. A strike is removed before then if the claimant retracts the notice, or if you submit a valid counter-notification and the material is restored.

You can see your current account standing, including any active strikes, in the app.

5. Messaging and calls

No access to emergency services. The Service is not a replacement for your ordinary mobile phone or fixed-line telephone. Vibz does not provide access to emergency services or emergency services providers, including the police, fire departments, or hospitals, and does not connect to public safety answering points. Make sure you can contact emergency services through a mobile, fixed-line, or other service.

6. Reporting and moderation

7. Feed and recommendation transparency

Vibz may rank and recommend posts, channels, groups, accounts, and other content based on signals such as the channels you follow, likes and comments from other users, how recently content was posted, what you have already seen and how long you watched it, your "not interested" feedback, and whether an account is under 18. Our Recommender & Feed Transparency page explains the current signals in detail.

We may reduce distribution, add warnings, age-gate, or remove content that appears spammy, deceptive, sensitive, unsafe for teens, or likely to violate our rules.

We do not guarantee that any content, channel, author, group, or account will be recommended, ranked, or shown to any particular user.

8. Privacy

Our Privacy Policy explains what we collect, how we use it, who we share it with, how long we keep it, and the choices you have. By using the Service you agree to that policy.

9. Account termination and deletion

10. Service "as is" — no warranties

To the maximum extent allowed by law, the Service is provided "as is" and "as available" with no warranty of any kind, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the maximum extent allowed by law, Vibz and its affiliates, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or use, arising from or related to your use of the Service. Our total aggregate liability to you for any claim arising from or related to the Service is limited to the greater of (a) the amount you paid Vibz in the 12 months before the event giving rise to the claim, or (b) US$100. Some jurisdictions do not allow these limits — those limits apply only to the extent permitted in your jurisdiction.

12. Indemnity

You agree to defend and indemnify Vibz from claims arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

13. Changes to the Service or these Terms

We may change the Service at any time. We may change these Terms by posting an updated version and bumping the version number; we will notify you in-app, and where the changes are material, will require you to accept the new Terms before continuing to use the Service. Continued use after the effective date of an updated version means you accept it.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of Missouri, USA, without regard to conflict-of-law principles. Before filing a claim, you agree to try to resolve the dispute informally by contacting legal@marketvibz.com; we will try to resolve it within 60 days. Disputes not resolved informally will be resolved in the state or federal courts located in St. Charles County, Missouri, unless the law where you live entitles you to bring suit elsewhere.

To the extent permitted by law, you and we must initiate any proceeding or action within one (1) year after the dispute first arose; otherwise the claim is permanently barred.
